Consignment Terms

These terms and conditions (“Terms”) govern the consignment or attempted consignment of item(s) (“Item(s)”) from you to La Bagatory & associates (“Lab”). By consigning to Lab, you AGREE to the following: 

  1. You are the legal owner of the Item(s) you are offering to sell / consign. You have full authority to sell / transfer the Item(s). The Item(s) do not include counterfeit goods, and is not the result of any illegal activity, including theft or fraud. Any transaction initiated by you will not cause Lab to be in violation of any anti-money laundering, or other applicable state or national law.
  2. You are responsible for ensuring the authenticity of Item(s) you sell/consign. If Lab cannot confirm the authenticity of the Item(s) you have provided, Lab shall have the right at its sole discretion to refuse to accept the Item(s). If Lab determines at any time that your Item(s) is counterfeit, you will be notified and be required to provide proof of purchase/other proof of authenticity acceptable to Lab. A penalty of RM200 per item (price differs for Hermes brand items) is payable if the Item(s) is found to be counterfeit. Lab has the right to dispose the counterfeit Item(s) should you fail to pay the penalty within seven (7) days from the date of notice or should you fail to retrieve the Item(s) within two (2) weeks after payment of penalty.
  3. Lab has the right to reject consignment or reconsignment of Item(s) which are not saleable due to condition or marketability. Clause 7 applies to the return process of these Item (s).
  4. Lab accepts the Item(s) from you on consignment basis only. You are responsible for all risk of loss or damage to the Item(s) until Lab takes physical possession of it. Lab will not be liable to any loss or damage to the Item(s) during shipment.
  5. If the Item(s) on consignment is damaged, stolen, or lost while in Lab’s possession, Lab will pay you the agreed consignment price. However, Lab will not be responsible for any natural damage caused by storage or humidity, including but not limited to, discolouration, stickiness, peeling or cracks on patent leather, tarnishing or rusting of hardware, or aging, cracking or peeling of leather.
  6. The consignment period with Lab is for a minimum of 60 days. If the Item(s) on consignment is repriced, the consignment period will restart from the date of the price adjustment unless otherwise agreed. Early retrieval of Item(s) before 60 days will incur a service fee of RM200 per item.
  7. Lab reserves the right to return any Item(s) at our discretion. Return Item(s) are to be collected / mailing address provided (of which return postage will be at your expense), within 2 weeks after being notified. Lab will provide two (2) reminder notices to collect your Item(s), after which Lab will assume ownership of this Item(s). Lab will not be held responsible for the safety of the Item(s) if you elect to get it posted back.
